Exwife is deploying. Can she designate her parenting time with someone else?

I am divorced and have sole custody and a 50/50 parenting plan with my exwife. My exwife is due to deploy with the Oregon National Guard and offered me a family care plan giving part of her parenting time to a “designated person” while she is away. Can she do that? What if I don’t sign it. Should I have the child while she is away as I have sole custody? Also how would I find out if and when she deploys?

  1. Jes says:

I would get this taken care of before she deploys because there is the Sailor and Soldiers Act once she’s out of the states. In my case the children stayed with me, I had full custody until he came back home to figure out the visitation/custody arrangements. We split during his deployment.

  2. I would first ask my lawyer. Second, I would ask her base Chaplain if she can do that! Her commanding officer can tell you when she leaves, etc. Do your research, and you can find out all you need to know!
